There is a new tradition now close to the day of judgement, that people come out and make excuse for the kufr leaders, and they quote ibn Abbas as saying kufr duna kufr on the ayah where Allah (swt) said:
“Whosoever rules by other than what Allah revealed, they are the Kafirun.” [5: 44]
This is the ayah that people use to prove that the rulers are not kafir. However the ayah is so explicit, that whosoever does so is Kafir, they wish to twist the ayah, and attribute to ibn abbas that he said that the kufr mentioned in this ayah, is kufr duna kufr, and therefore they conclude that the leaders today are not Kafir.
Kufr is opposite to Imaan, so when Allah (swt) says that “whoever rules by other than what Allah revealed, they is The Kafirun.” We cannot now say that they are Muslims, or that it is kufr less than kufr.
Furthermore, the reason why the people call them Kafir is not because of this ayah, however it is easily proven that they are Kafir even without even to use the ayah. The existing leaders are Kafir for the following reasons:
1- Violation of the First Pillar of Tawheed
They did not fulfil the two pillars of Tawheed, the one who does not have the pillars of Tawheed is Kafir, the first pillar is Al Kufr Bil Taghout, the leaders do not reject the Taghout, and so they are Mushrik and Kafir.
Anybody who believes in Allah without to reject the kufr and the taghout is not Muslim.
Allah (swt) said:
“…Whosoever disbelieves in taghout and then believes in Allah has grasped the most trustworthy handhold that will never break.” [EMQ 2: 256]
The Imaan of the rulers without to reject taghout is like the imaan of Quraish, the Quraish used to believe in Allah, and that he was the creator, but they did not reject taghout, and Muhammad (saw) fought against the Quraish because they did not reject taghout, though they did believe in Allah (swt).
They do not reject the Taghout of United Nations, the United Nations is a constitution based on certain rules, it is a kufr organization based on sovereignty for man, anything that gives sovereignty to anything other than Allah (swt) is Taghout. All the rulers willingly apply to be a member of the UN, and pay willingly to maintain their membership, and they willingly adhere to their rules and kufr law, they adhere to the kuffar to be in authority over them and all the Muslims, they accept for the five Kafir countries in the security council to have an upperhand over them.
Allah (swt) says:
“Have you seen the one who claims to believe in that which Allah has revealed to you, and that which was revealed before you, and they refer in their disputes to the taghout and they have been ordered to reject it.” [EMQ 4: 60]
Allah (swt) said here that anyone who refers to taghout in disputes, should not claim to be Muslim, and this ayah is speaking about a Muslim not a Kafir, who did not want to refer to Muhammad (saw) and instead to a jew, Ka’b ibn Ashraf in his dispute, and Allah called him hypocrite and Kafir.
All the rulers are agreeing to sit with all the kuffar and Mushrikeen from all over the world in the U.N. this is KUFR AKBAR and makes them Kafir.
2- AL ISTIHZAA’ - MOCKING/RIDICULING ALLAH’S (SWT) DEEN AND COMMANDS
This is one of the most dangerous diseases that is faced by the Muslims. It came from outside of Islam. There are many books that mock the deen of Islam. There is a book called “How Adam was created”, it speaks about the claim of the evolution in opposition to Islam. There are many books that make caricatures for Muhammad (saw), and these books are legal and licensed in the Muslim Countries.
- They Mock the Ulemah
- The sisters who cover
- The da’ees
- Those working for Islam
- They mock Ahl Al Islam
The Prophet (saw) said:
“Whoever mocks my ummah, and my companions has no sanctity for his life.”
Many sisters in Muslim countries are barred from universities if they cover, and many Muslim men are prevented from studying medicine unless they remove their beard.
There are people who mock the Arabic language - the language of the qu’ran, in many Muslim countries, they call the “Arabic language the backwards language, and would even say that it is better to be illiterate than to learn Arabic, and they say that the only way to make qur’an recognizable is to translate it into latin, French or English, because English is the most respected language and Arabic is humiliated”, this is apostasy, and the one who said so (i.e. Taha Hussein), is apostate.
They mock the Hudud, they say it is barbaric and said that if the arabs used to do so, to cut the hands and stone the adulterer, they claim it is because they are ’backwards, bandits, bloodthirsty etc.’ they say that the qur’an is not applicable for the ‘civilised’ world today, and ‘it is better to read the newspaper than the qur’an’, these people who say so are apostates. There are books that say that any book that would speak about cleaning the heart of the Prophet (saw) should be banned even if it is Al Qur’an.
All these books are legal in the Muslim Countries, and this is proof of the apostasy of the leaders. Allah (swt) called a group of people Kafir in the Qur’an because they ridiculed the Deen of Allah (swt):
“The munafiqun fear lest a surah should be revealed about them showing them what is in their hearts, say ‘go ahead and mock but certainly Allah will bring to light all that you fear. If you ask them, they declare: ‘We were only talking idly and joking.’ Say: ‘Was it at Allah and his ayaat that you were mocking? Make no excuse you have disbelieved after you believed.” [9: 64-66]
This ayah is about people who just spoke slightly ill about the Hafiz of the Qur’an, they said they, the hafiz are just people with big tummies, and Allah (swt) called them KAFIR.
“If We delay the penalty for them for a definite term, they are sure to say, "What keeps it back?" Ah! On the day it (actually) reaches them, nothing will turn it away from them, and they will be completely encircled by that which they used to mock at! [EMQ Hud: 8]
Furthermore, the rulers give permission for programs in television in the Muslim countries with license, allowing kufr ideas and thoughts to prevail under the pretext of freedom of speech, they allow the Qur’an to be recited after all nudity and haram is shown on the TV, they allow advertising for alcohol and nudity. They have programs mocking women who cover, and imams, and programmes mocking the hafiz, and the ‘fundamentalists’, and even programs depicting the companions and the tabi’een as bandits. The one who legislates this kind of mocking is KAFIR.
They permit all haram and corruption on the television and then break for salah, or they mention the time for salah i.e. mixing Islam with all their fusq, fujur and kufr.
They allow programmes on the TV, to insult the khimar and Jilbaab, insulting the scholars. They allow advertising for riba’ and all types of haram. They imprison the one who insults the rulers but cry ‘freedom of speech’ for the one who insults Allah (swt). This is one of their many acts of Kufr, that they mock the Deen of Islam.
3- AL MUWALAAT UL MUSHRIKEEN WAL KAFIREEN - ALLIANCE WITH THE KUFFAR AGAINST MUSLIMS
“O you who believe, do not take the Jews and Christians as friends, they are only friends with each other, and whoever takes them as friends are one of them.” [EMQ 5: 51]
How did the rulers ally with the kuffar? Allah (swt) says:
“Why should you be divided into two parties about the Hypocrites? Allah has upset them for their (evil) deeds. Would you guide those whom Allah has thrown out of the Way? For those whom Allah has thrown out of the Way, never shall you find the Way. They but wish that you should disbelieve, as they do, and thus be on the same footing (as they): But take not friends from their ranks until they make hijrah in the way of Allah. But if they turn back, seize them and slay them wherever you find them; and (in any case) take no friends or helpers from their ranks.” [EMQ 4: 88-89]
This ayah speaks about those Muslims in Makkah who apostatized by joining the Quraishi Army against the Muslims in Badr out of love for their land and people, when they came to Madinah the Muslims killed them, this is for a small alliance with Quraish once, and they believed in laa ilaha illalllah, yet they were killed for their kufr.
Israel has a security pact with Turkey, Egypt and Qatar. Saudi Arabia has security pact with USA, they have allied with the kuffar against ALL the neighboring Muslims in the region. Iraq did not even enter into Saudi Arabia, and yet they allowed USA to come and fight against the Muslims in Iraq. Allah (swt) says:
“Those in whose hearts is a disease - you see how eagerly they run about amongst them, saying: "We fear lest a change of fortune bring us disaster." Ah! perhaps Allah will give (you) victory, or a decision according to His will. Then will they repent of the thoughts which they secretly harboured in their hearts. And those who believe will say: "Are these the men who swore their strongest oaths by Allah, that they were with you?" All there deeds are lost, and they will fall into (nothing but) ruin.” [EMQ 5: 52-53]
4- AL ISTIBDAAL - ADOPTION OF ANOTHER DEEN (EMBRACING DEMOCRACY)
They say that they adhere to democracy, meaning that they accept sovereignty for man. Allah (swt) says:
“Allah ordered you to return the huquq to the people and if you rule and judge between people, you rule by Shari’ah (i.e. Al Adl - justice).” [EMQ 4: 58]
“The only deen Allah accepts is Al Islam.” [EMQ 3: 19]
About the time of Yusuf (as), Allah (swt) says:
“I left a millah of people who do not believe in Allah, and in the hereafter will not believe, and I follow the millah of my fathers, Ibrahim, Ishaq and Ya’qub, and never could we attribute any partners whatsoever to Allah …” [EMQ Yusuf - 12: 37-38]
He called the mixing of the deens shirk. This ayah is in complete opposition to democracy. Furthermore the Hadith on the authority of Abu Huraira that the prophet (saw) said:
“Whoever says laa ilaha illallah and rejects any other way of life, his life and wealth will be protected …”
This Hadith obliges us to reject all other deens, and Democracy is a complete contradiction as you will not reject any other deen if you embrace democracy. Allah (swt) says:
“And whosoever seeks a deen other than Islam, it will never be accepted.” [EMQ 3: 85]
5- SHIRK UL RUBUBIYYAH - DIRECTING SOME OF ALLAH’S (SWT) ATTRIBUTING TO THEMSELVES
Allah’s (swt) deen is not implemented in any of the Muslim lands today, rather the rulers are taking on Allah’s attribute to be the commander and the legislator, in any parliament legislates law and even legislates what Allah (swt) has forbidden, or worse forbidding what Allah (swt) obliged. In the Muslim countries today, no country obliges Khimar and Jilbaab for the women, worse than that they even punish the one who wears it in some countries.
In the Muslim Lands, you will be punished if you just attack the constitution, or the leader, or the flag, you will be severely punished as a traitor.
Under Man-made law, you will be punished for breaking any man-made law, e.g. going through the red traffic light, however if you disobey Allah’s (swt) law, then you will not be punished (under Man-made Law), so the dilemma will arise as to which to uphold.
This is why they are taghout and Kafir, and anybody who helps them and upholds their law, whether military or not, is taghout and Kafir, even if he is just an ordinary citizen. However those others who do not uphold his law, and work against the rulers is not taghout, nor Kafir.
In the Muslim countries you can insult Allah and His Messenger, without to be punished at all, however if you swear against their ministers, then you can get up to three years in prison.
"They take their priests and their anchorites to be their lords in derogation of Allah, and (they take as their Lord) Christ the son of Mary; yet they were commanded to worship but One Allah: there is no god but He. Praise and glory to Him: (Far is He) from having the partners they associate (with Him).“ [EMQ 9: 31]
“are many different lords are better or one? …”
From this angle the rulers are Kafir by Istihlal – permitting what Allah (swt) forbids.
6- AL TASHREE’ - THEIR KUFR CONSTITUITION
They all have kufr constitutions violating the shari’ah and taking them out of the fold of Islam, Allah (swt) clearly condemned the one who makes Al Tashree’, those who legislate and rule by other than what Allah (swt) revealed. Allah (swt) says:
“Allah ordered you to return the huquq to the people and if you rule and judge between people, you rule by Shari’ah.” [EMQ 4: 58]
“If you rule between them, rule by Shari’ah (Justice is Shari’ah).” [EMQ 5:42]
and Allah warned us from implementing any other constitution or law,
“Do they wish to go to the law of jahiliyyah? Who is better in legislation than Allah?” [EMQ 5: 50]
and Allah says,
“The right of legislation is for none but Allah, …” [EMQ 6: 57]
“Say: "Who is it that delivers you from the dark recesses of land and sea, when ye call upon Him in humility and silent terror: 'If He only delivers us from these (dangers), (we vow) we shall truly show our gratitude'?" [EMQ 6: 63]
“Say: "Shall I seek for judge other than Allah? - when He it is Who hath sent unto you the Book, explained in detail." They know full well, to whom We have given the Book, that it hath been sent down from thy Lord in truth. Never be then of those who doubt.” [EMQ 6: 114]
“The power of legislation is for none but Allah.” [EMQ 12: 40]
This ayah was revealed in relation to ruling about Yusuf (as). Allah also says,
“Further he said: "O my sons! enter not all by one gate: enter ye by different gates. Not that I can profit you aught against Allah (with my advice): None can command except Allah: On Him do I put my trust: and let all that trust put their trust on Him." [EMQ 12: 67]
“See they not that We gradually reduce the land (in their control) from its outlying borders? (Where) Allah commands, there is none to comment on His Hukm: and He is swift in calling to account.” [EMQ 13: 41]
“He (swt) does not associate in his ruling anybody.” [EMQ 18: 26]
The ayah says “Do not associate yourself with Allah’s ruling.”
“He is the lord, there is no god but him, he is blessed in the dunya, and elevated in the akhirah, and none has the right of legislation but him.” [EMQ 28: 70]
Verily, the implementation of kufr law and legislation of man-made law is clear disbelief and none from the rulers of the muslim lands have any excuse in the matter.
THE ARGUMENTS ATTEMPTING TO PROTECT THE TAWAGHEET
1- KUFR DUNA KUFR
The Leaders are full of kufr and shirk, and yet there are always people who will try to protect them and call them Muslim. They refer to the Hadith of ibn Abbas, that he said “kufr duna kufr” about the ayah [5: 44]. They refer this to the Tafseer of ibn Kathir. However when we speak of this issue regarding ibn Abbas, we will have an argument over its very authenticity.
This Hadith in question was at the time of the Khawaarij, they came to discuss with him, he never called them Kafir, he said “kufr duna kufr.” He was debating with khawaarij, it must be noted that there was not an issue of any absence of Shari’ah, the shari’ah was present in his time, there was never in his time a ruler attempting to rule by kufr law, no one claimed that sovereignty was for man besides Allah, no one that he faced from the khawaarij when he said the statement, was from the reality of the rulers of the Muslim Lands.
Hisham ibn Hajar Al Makki, who was a weak narrator such that no one accepts his narration - is the very one who is reported that ibn Abbas said so. And in fact there is Ijma’ that anyone who legislates a single Hukm, is Kafir.
The Da’eef narration states that the khawaarij spoke to ibn Abbas about the arbitration of Ali and Mu’awiyah and those with them, they said:
“How dare you arbitrate to a man instead of Allah, and Allah (swt) says, “whoever rules by other than what Allah revealed, they are Al Kafirun.” And so Ali and Mu’awiyah are Kafir.” Ibn abbas here said “this type of arbitration is kufr duna kufr.”
So even if the Hadith was Saheeh, the subject matter is not the same as the reality of the taghout rulers in the Muslim lands, however the Hadith is weak, and so cannot be taken regardless.
Ibn Abbas said in another narration, responding to the khawaarij’s claim:
“Reconciling between the Muslims is not ruling by other than what Allah revealed. If a husband and wife dispute, send one from her family and one from his family. Allah permit to arbitrate to man to reconcile between husband and wife, and so for greater reason it is allowed to arbitrate to a man to reconcile between [4: 35 + 65: ]… it is not as you think.”
This narration is saheeh and contradicts what the weak narration says, because he doesn’t attribute even sin to Ali or Mu’awiyah as he does in the weak narration, rather he clears them of all fault.
Even if not, it can only be used as kufr duna kufr not if someone rules by kufr law, but rather if they oppress the people, and do not give the rights to the people. This is sin, not kufr, however the subject matter of the ayah is not that, and anybody who rules by kufr law is Kafir.
Bara’ bin Azib said On the ayah [5: 44, 45 and 47]
“These ayat were revealed all about the kuffar.” [Muslim, asbab ul nuzul [5: 44, 45, 47]]
So there is no way that these ayaat are speaking about kufr duna kufr, it is impossible because the kuffar are Kafir. It must be Kufr Akbar.
If the khawaarij apply the ayah as it has been mentioned addressing the situation of the Jews, there would be no dispute, because the kufr will be the same kufr and there would be no ta’weel.
On the ayah
“It was We who revealed the law (to Moses): therein was guidance and light. By its standard have been judged the Jews, by the prophets who bowed (as in Islam) to Allah's will, by the rabbis and the doctors of law: for to them was entrusted the protection of Allah's book, and they were witnesses thereto: therefore fear not men, but fear me, and sell not my signs for a miserable price. If any do fail to judge by (the light of) what Allah hath revealed, they are Kafireen.” [EMQ 5:44]
These ayaat are clearly speaking about the people of the book, so how can it be speaking about kufr duna kufr.
If it was speaking about the believers from the people of the book, it could be acceptable however there were no believers from the people of the book at the time of the prophet (saw), or it must be applicable to both Muslims and kuffar, however if you do so, you cannot apply kufr duna kufr as it is originally speaking about the kuffar.
We must remember ibn abbas was never speaking about the situation of the taghout rulers, or ruling by kufr law, even in the da’eef Hadith, he was speaking about arbitration, it is very dangerous to attribute to a sahabi that he said as they claim that the taghout rulers are not Kafir.
2- THEY SAY LAA ILAHA ILLALLAH
They argue that they say laa ilaha illallah, and so how can we call them Kafir.
Umar Al Ashkar said:
“how can you call them Kafir? They are people who say laa ilaaha illallah, and the prophet (saw) forbid usama, for killing someone after he said laa ilaha illallah, and the Hadith says do not say to the one who says to you salam, that he is not a believer.”
“He it is Who has sent down to thee the Book: In it are verses Muhkamaat and they are the foundation of the Book: others are mutashabihaat. But those in whose hearts is perversity follow the part thereof that is allegorical (mutashabihaat), seeking discord, and searching for its hidden meanings, but no one knows its hidden meanings except Allah. And those who are firmly grounded in knowledge say: "We believe in the Book; the whole of it is from our Lord:" and none will grasp the Message except men of understanding.” [EMQ 3: 7]
Telling you that not everything is open to Ijtihad, some things are clear-cut and undisputable, only some of them are disputable, that if something comes general, Allah will specify further. For example Allah (swt) said: “pray…” it is abstract (Mujmal), Allah explained in another text how many times a day etc, no Alim can look to this and tell you how to pray.
The claim that the leaders say laailaha illallah, can be countered in the light of this evidence. And the Hadith which they quote out of context that says: “whoever says laailaha illallah will enter Jannah.” The Hadith in fact reads whoever says laa ilaha illallah believing in his heart will enter paradise.”
The ayah says:
“Those who disobey Allah and his Messenger will stay in hellfire forever.”
This is why the Khawaarij get confused, because those who will stay in hellfire forever are the kuffar, so they take all the disobedient to be Kafir. However Allah (swt) explained this verse in another ayah, where he (swt) says
“Allah does not forgive Shirk, but Allah forgives everything else less than that.” [EMQ 4:115-116]
Furthermore Imaan is not just to say it, it is to say it believing it and acting upon it. Al Imaan is in the sayings, actions and in the heart, if any of these three pillars are missing or negated e.g. with the word or action of kufr, the entire Imaan is negated. So that is why however much the rulers say laa ilaha illallah, when that is accompanied by the Big Shirk or the Big Kufr e.g. to prostrate in front of the Idol or to rule by other than Allah revealed or to mock Allah or his Deen etc, they will leave the fold of Islam knowingly or unknowingly, Verily Allah (swt) informed us about people who will say the kalimah and claim to believe in Allah and in Islam, yet they are Mushrik because of their arbitration to the Taghout (e.g. arbitration to the western courts or man-made law, United Nations, International Law or any judge who rules by other than what Allah revealed), Allah (swt) says,
"Have you seen those who claim to believe in what was sent to you and sent down before you? And they wish to go to judgement in their disputes (At Tahakum) to the Taghout while they have been ordered to reject them, but Shaytan wishes to lead them far astray." [EMQ 4: 60]
